One of the questions raised in the discussion of international criminal law is what are the duties of the attorney general as one of the senior officials of the judiciary in the Iranian judiciary and in order to protect and restore public rights in international criminal affairs and what are the powers of attorney generals? In international affairs, especially issues related to the extradition of foreign nationals or the suspension of their prosecution. Recent research with descriptive –analytical method shows that in the judicial system of the Islamic Republic of Iran, attorney generals have duties and powers regarding the extradition of foreign criminals and the suspension of their prosecution in the territory of Iran. However, It seems that the legislator, considering international developments and the increase presence of foreign nationals in Iran, as well as the growing trend of Iranian immigration abroad should take a more effective step to clarify the prominent role of the attorney general in the extradition of foreign criminals and take away international criminal issues.
