A Review of the Punishment Set forth in the Iranian Anti-Terrorism Financing Act 2018

Abstract
The first anti-terrorism financing law in Iran was passed in 2015 with a delay of several years, but despite the late approval and due to the favorable reforms made by this law in 2018, it can be said that our country has taken a positive step to combat this crime. The proportionality between punishment and crime is one of the components of a balanced criminal system. The logical basis for punishment is one of the basic principles of the criminal justice system and its legitimacy factor. The fundamental question is whether appropriateness in the law against financing has been observed in punishment. By reviewing the law, it was observed that in Article 2 of this Law, a combination of Hadd and Ta'zir punishments is provided as punishment, but the conditions for applying each of them are not stated, which results in different punishments against individuals in similar situations.
