Migrants are the primary subject of a new branch of international law called International Migration Law. According to the definition of the United Nations, those who reside in a country other than their country of origin with the intention of staying for a period of more than twelve months are considered migrants. The first right of migrants is the right to freedom of movement, which is protected in various documents. In migration management, the mutual relationship between governments and migrants is considered. Since this research is carried out using a library method, it will show the results by analyzing the content extracted. The aim of this article is to examine the legislative criminal policy of the Islamic Republic of Iran regarding the victimization of migrants, and its main question is: What is the policy adopted by the Iranian criminal justice system in legislation regarding the phenomenon of migrant victimization? As a result, merely implementing control and strict policies regarding migrants cannot guarantee the security and interests of governments. In this regard, governments, by committing to international documents and within this framework, should formulate their policies and programs. In fact, accepting migrants and paying attention to the positive effects of international migrations reduces anti-immigrant views and ensures that the civil rights of this vulnerable group are observed at the international and domestic levels.
