With the increasing advancement of artificial intelligence technologies, legal and criminal issues related to liability for damages caused by them have become a more complex challenge globally and in Iran. This article has conducted a comparative study of liability for damages caused by artificial intelligence in the legal systems of Iran and China. The aim of the research is to identify the similarities and differences between the laws and judicial procedures of these two countries in the field of civil and criminal liability resulting from the use or development of artificial intelligence technologies. The importance of the subject is the need to formulate coherent and transparent legal and criminal laws for compensation for damages caused by artificial intelligence and to assess the impact of these laws on the rights of consumers and producers. The main question of the research is how liability for damages caused by artificial intelligence is determined in the criminal laws of Iran and China and what are the differences between these two countries? The research findings show that the existence of a few articles in Iranian law cannot provide a deterrent response to criminal liabilities and damages caused by artificial intelligence. China has made more progress in developing appropriate legal frameworks in this area due to its stronger legal and regulatory structure, but both countries accept liability based on fault and negligence in compensation for losses. The research method is analytical-descriptive and comparative comparison is used for comparative analysis of laws.
