Cultural genocide is an aspect of the attempt to systematically and intentionally destroy and annihilate a nation, ethnic group, or group, along with physical and biological genocide in international law. The present article, written using library resources and using a descriptive and analytical method, aims to examine the history of cultural genocide and its components of separation from physical genocide and the possibility of committing and punishing the perpetrators of this crime in the practice of international courts. The findings and results of this research indicate that a nation is not just a collection of individuals, but also a collection of cultural and social relations between a nation, ethnic group, or group, and is formed by social and moral norms; however, the actions of states and individuals that lead to the desecration and destruction of cultural symbols and the disintegration of the basic cultural and social foundations with the aim of destruction; also destroy the group's communication throughout history and time between generations; which can be considered as cultural genocide. Therefore, due to the generality and applicability of the legal provisions governing genocide in the Statute of the International Criminal Courts and the relevant convention, it is appropriate that perpetrators of the crime of cultural genocide should not go unpunished.
