The fate of the Gaza Strip after October 7, 2023, was the loss of lives of tens of thousands of defenseless people, including minors and women, the forced displacement of hundreds of thousands of people, the destruction of civil infrastructure, the bombing of hospitals, and the cutting off of public access to vital resources such as oxygen, water, medicine, and fuel. Given this critical situation, the fundamental questions are: From the perspective of international criminal law, which criminal titles do the series of actions of the Zionist regime in this strip correspond to, and which authorities have the possibility of intervention to prosecute its leaders? The findings of this study, whose method is descriptive and analytical and whose data collection tool is a library, indicate that the criminal descriptions of the series of behaviors committed in this conflict are multifaceted and include genocide, crimes against humanity, war crimes, and crimes against humanity. However, criminal prosecution of those involved in it in transnational judicial bodies such as the International Criminal Court is possible based on foreseen mechanisms such as the initiative of the prosecutor of this institution, despite the existence of legal and political obstacles.
