A View to the Crime of Extermination in International Criminal Law

Abstract
So far, the international community has identified and criminalized four crimes as international crimes. One of these crimes related to the field of international criminal law is crimes against humanity committed in the context of a widespread or organized attack by a government or group against a civilian population. One of the examples of these crimes is destruction or eradication. In this research, the crime of extermination in international criminal law was investigated with descriptive analytical method and library information collection. The result of the research shows that the crime of Extermination is one of the most common and oldest international crimes that has occurred many times throughout the history of mankind and is one of the international crimes with customary characteristics that, as one of the examples of crimes against humanity, is dealt with under the jurisdiction of the International Court of Justice. It has been criminalized internationally and its concept and criminalization is derived from the crime of genocide. In the end, it was concluded that this crime, unlike genocide, does not require specific malice against national, religious, ethnic and racial groups. The mentioned crime can be realized in international armed conflicts.
