Comparative Study on Stalking in Criminal Law

Abstract
One of the cases of crimes against individuals is the stalking, which is actually a crime against one's mental freedom. The various instances of this criminal behavior have been explicitly stated in the laws of many countries and have been considered as a misdemeanor in most cases. Iranian criminal law is silent in this respect. The existence of this behavior against individuals in the community, as well as its expansion in the real world and also through cyberspace, in addition to offenses and damages caused by such behaviors, including the fear of insecurity in citizens, necessitates legislative intervention in this regard. The present article attempts to make a comparative analysis of this behavior and its elements, including the legal, mens rea and actus Reus of this crime, by using a descriptive-analytic method. Then, practical and comprehensive suggestions have been presented to the legislator for removing this legal silence.
