Ecocide is one of the most prominent environmental damages that the international criminal court can effectively play a role in this regard. Environmental crimes and beyond that climate crimes have caused a lots of damages to the biosphere. In this regard, environmental degradation, periodic drought, and global warming are among the dangers that have occurred due to climate change, and the fact that violations of international obligations are practically unpunished has caused this problem to become more critical every day. The emission of greenhouse gases and insufficient commitments have added to these miseries and caused this issue to conflict with environmental justice and practically try to put it under the criminological microscope of the advocates of global jurisdiction. The current research seeks to answer the question, how close is the modernization of the international criminal law system to the realization of the criminalization of climate risks in the light of environmental justice? Our findings in this research actually confirm the hypothesis that the existing capacities indicate the realization of climate criminalization, but the international obligations and responsibility of the governments do not match this trend.
