Impunity is one of the important concerns of international criminal law, which has received increasing attention in recent decades. In this paper, an attempt has been made to examine the important question of how impunity in international criminal law can be analyzed in the light of the rule of negation of the dominance. The present paper is descriptive and analytical and has investigated the mentioned question applying the library method. The findings indicate that impunity in international criminal law emphasizes the punishment of criminals using the judicial assistance of governments, the extradition of criminals and judicial representation. The rule of negation dominance, which means the non-dominance of foreigners over a Muslim, does not contradict the methods of achieving impunity, such as judicial assistance between countries, extradition of criminals, and judicial representation, because in Islam, the necessity of punishing criminals is also emphasized and fighting against impunity is accepted. On the other hand, the conditionality of "dominance negation" on the non-creation of a cause by a Muslim and the adjustment of the "dominance negation" rule with the rules of peaceful life are among the reasons that are raised in the absence of conflict with the rule of dominance negation with the extradition of criminals, judicial cooperation and judicial representation. The extradition of criminals, judicial cooperation and judicial representation do not mean the domination of foreign countries over Muslims, but it is a kind of mutual cooperation based on cooperation treaties, which helps to realize the judicial justice emphasized by Islam. Based on this, it seems necessary to pay attention to the extradition of criminals, judicial assistance and judicial representation at the international level in order to deal with impunity on the part of the domestic legislator.
