Abstract
One of the founding principles of fair trial lawyer in the right to stage is a preliminary investigation. In the Criminal Procedure Code of 2013, this important right has been referred to as a new invention and the absence of a lawyer in preliminary investigations has led to the invalidity of the investigations. A comparative study of the presence of a lawyer in the preliminary investigation phase with the UK legal system has been carried out as a research work and the researcher has concluded that Iran has not only accepted this right like the Countries of the United Kingdom, but has gone one step further and at the beginning of the arrest has recognized this important right for the accused.
